Dairy MDL Judge De-certifies Sub-Class
A Tennessee Judge recently De-certified a sub-class of the ongoing Dairy MDL, which was set for trial on August 16, 2011. The sub-class included current members of Dairy Farmers of America (DFA). On Friday, The District Judge held a hearing for reconsideration of the de-certification. He decided to take the arguments under advisement for a later ruling on the issue.
What does this mean for the DFA-members who have been removed from the class? Technically, those DFA-members are no longer represented by the class counsel at this point. Should the Judge decide to re-certify the subclass of DFA-member farmers; then, they could join in the class action again.
Vicki B. Eastland with Eastland Law Offices recently filed an Amended Complaint on behalf of DFA member and non-DFA member dairy farmers. The action, which seeks damages for farmers who sell their milk within Federal Milk Order 7, is pending in the Southern District of Mississippi and alleges Antitrust and RICO violations by the Defendants.
